Welcome to DeFyne Performance. By purchasing and using any of our products, services, or engaging in our coaching programs, you are agreeing to the following terms and conditions. These policies are designed to protect both parties and ensure transparency, accountability, and mutual understanding of expectations

No Refund, Exchange, or Return Policy

All sales of services and products through DeFyne Performance are final. Due to the nature of our offerings, which include digital products (downloadable PDF programs), one-on-one coaching services, and online consultations, we do not offer any refunds, exchanges, or returns for any of our services or products. This policy applies under all circumstances, including but not limited to:

- Change of mind after purchase.
- Lack of satisfaction with the service or product.
- Inability to commit to the coaching or consultation sessions.
- Failure to use or engage with the provided materials or services.

By agreeing to these terms, the customer acknowledges that they understand the nature of our services and products and accept full responsibility for their purchase.

Liability Disclaimer

All products, services, and coaching programs provided by DeFyne Performance are intended for educational and informational purposes only. The advice, programs, and resources offered through our platform do not replace professional medical advice, diagnosis, or treatment. By engaging with our products and services, the customer understands and agrees to the following:

- Personal Responsibility: Customers acknowledge that they are participating in fitness programs, consultations, or services voluntarily, and at their own risk. They are solely responsible for their actions and outcomes, and agree to assume full responsibility for their progress and results.

- Medical Disclaimer: It is the responsibility of the customer to seek medical advice from a qualified healthcare provider before participating in any fitness programs or following nutritional recommendations. DeFyne Performance does not assume responsibility for any health issues or injuries that arise from participation in our programs or services. The customer agrees to consult with a healthcare provider before making any changes to their exercise routine, diet, or lifestyle based on the information provided.

- Coaching and Fitness Programs: All recommendations and advice provided through coaching services are made based on the customer’s input, and it is the customer’s responsibility to fully disclose any medical conditions, physical limitations, or relevant information that could impact their fitness or health during the coaching process.

Results Disclaimer

Results from fitness coaching, consultations, or programs vary from person to person and are dependent on multiple factors such as individual effort, consistency, physical condition, and adherence to the program guidelines. DeFyne Performance makes no guarantees or warranties regarding the outcomes of any fitness or nutritional program.

By participating in our services, the customer understands that success in any fitness or health-related program is subjective and dependent on various personal and environmental factors. The customer agrees not to hold DeFyne Performance liable for any perceived or actual lack of progress or results.

Cancellation and Rescheduling Policy

For coaching sessions or consultations, cancellations and rescheduling requests must be made at least 24 hours in advance. Failure to provide sufficient notice will result in the forfeiture of that session, and no refunds, rescheduling, or extensions will be granted.

Payment Terms

All payments for services, subscriptions, and products are due at the time of purchase. For subscription services with recurring billing, the customer agrees to maintain an active and valid payment method on file. In the event of failed payment, services may be suspended until payment is successfully processed.

Subscription Terms: Customers subscribed to coaching services with recurring payments will be billed on a bi-weekly or monthly basis, depending on the selected plan. All subscription payments are non-refundable, and cancellation of a subscription does not entitle the customer to any refund for previously billed services.

Intellectual Property

All content, materials, programs, guides, and resources provided by DeFyne Performance, whether downloadable or accessed through coaching services, are the intellectual property of DeFyne Performance. Unauthorized distribution, sharing, reproduction, or commercial use of any material without prior written consent is strictly prohibited. The customer agrees to respect the proprietary nature of all materials and content provided.

Confidentiality and Data Protection

We are committed to protecting your personal information and privacy. All information shared during coaching sessions, consultations, or in any communication with DeFyne Performance will be treated as confidential and will not be shared with third parties without your express consent, except where required by law.

Limitation of Liability

To the maximum extent permitted by law, DeFyne Performance and its owners, employees, affiliates, and partners will not be liable for any direct, indirect, incidental, or consequential damages resulting from:

- The use or inability to use our products or services.
- Any physical injury, harm, or health-related issues arising from participation in our fitness programs or coaching.
- Technical issues or delays in delivery of digital products.

In the event of any dispute, DeFyne Performance’s total liability will be limited to the cost of the service or product purchased, and no more than that amount will be awarded as damages.

Governing Law

This policy and all disputes arising from the use of our services or products are governed by and construed in accordance with applicable laws, without regard to any specific jurisdiction. Any legal disputes will be resolved in a manner consistent with those laws.

Changes to this Policy

DeFyne Performance reserves the right to update, modify, or change these terms and conditions at any time. Any changes will be posted on this page, and customers will be bound by the updated policy from the date of publication.

By purchasing and engaging with DeFyne Performance’s products and services, the customer acknowledges that they have read, understood, and agreed to all the terms and conditions outlined in this policy.
